The ITI VR Crane & Rigging Library Subscription and Support Terms (the “Terms”) are agreed to by and between Industrial Training International, Inc., a Washington corporation (“ITI”) and any active Licensee (the “Licensee”) of the ITI Virtual Reality Simulation Software and Hardware (the “System”). These Terms are hereby incorporated with and into the End-User License Agreement for the Software (the “EULA”). Capitalized terms not defined herein shall have the meaning set forth in the EULA. These Terms are subject to change at ITI’s sole discretion. Licensee’s use of the System shall constitute acceptance of these Terms.

A. Remote Hardware Software Support: ITI will provide website-based, email, and telephone support on a business day basis. A business day is defined as 8:00 AM through 5:00 PM Pacific Standard Time, excluding holidays and weekends. ITI will use its commercially reasonable best efforts to address reported and reproducible errors in the Software or Hardware.

B. Software Bug Fixes: Administrators will continuously work with ITI VR to ensure the latest versions of simulations are installed on their computers so that software bugs are resolved. Not all software bugs will be resolved immediately but prioritized based on severity.
C. Administrator Training E-Learning: Administrators will have access to a training library including videos and procedures on software and hardware use, training plan development, and more.
D. On-Site Simulator Commissioning: ITI VR can install and commission simulators at the Licensee’s request for up to 2 days on-site with travel costs reimbursed.
E. Monthly Administrator Success Calls: ITI VR are available to host a monthly phone call with administrators for 30 minutes to ensure success, review questions and comments, and help with user adoption.
F. Existing Scenario Updates to Licensed Crane Models:Updates and new scenarios released for crane types already licensed to the Licensee’s simulator will be made available at no cost. During the term of this agreement, ITI may from time to time provide the Customer with patches, updates, releases and latest versions of the Software along with other generally available technical material. These maintenance materials including the Software may not be used to increase the licensed number of versions or copies of the Software. The Customer agrees not to use or transfer the prior version but to destroy or archive the prior version of the Software. All patches, updates, release and new versions shall be subject to the applicable Licensee EULA.
G. New Crane Types: New crane types released by ITI VR will be made available in software updates depending on the Licensee’s Agreement. If additional hardware is needed to utilize a new crane type (e.g. overhead crane simulation with remote “belly-box” controls), that hardware must be purchased from ITI VR.
H. New Simulations: New simulations released by ITI VR will be made available in software updates depending on the Licensee’s Agreement. This feature is referring to all simulations outside of “New Crane Types”, for example, simulations for rigging, signaling, assembly/disassembly of cranes, inspection and more. If additional hardware is needed to utilize a new crane type (e.g. overhead crane simulation with remote “belly-box” controls), that hardware must be purchased from ITI VR.
I. New Training Plans: New Training Plans released by ITI VR will be made available in software updates depending on the Licensee’s Agreement. A Training Plan is like a course; it is a specific set and order of scenarios to achieve certain learning objectives.
J. Cloud-Based Learning Management System: Administrators will have the ability to manage users, assignments, training plans, and records in the ITI LMS depending on the Licensee’s Agreement.
K. LMS Integration to Licensee’s LMS: The ITI LMS is integrated into the Licensee’s organization’s LMS so that there is a single source of user records, authentication process, and management.
